Online Education Terms and Conditions

These Terms & Conditions (“Terms”) govern the purchase, enrolment, access and use of all online education, digital products, downloadable resources, assessments and related services provided by The Lash Edit and The Lash Institution (“we”, “our”, “us”).
By purchasing, enrolling in, accessing or using any of our Courses, you acknowledge that you have read, understood and agree to be legally bound by these Terms.
1. Definitions
For the purpose of these Terms:
Course means any online education program, digital training, downloadable material, assessment, workbook, template, video lesson, document or educational content supplied by The Lash Edit or The Lash Institution.
Course Materials means all educational content provided within a Course, including but not limited to videos, manuals, PDF documents, worksheets, assessments, images, graphics, templates, presentations, audio recordings, quizzes, downloads and written content.
Student means the individual who purchases or accesses a Course.
Platform means the online learning system through which Course Materials are delivered.
Certification means a Certificate of Completion issued by The Lash Edit and The Lash Institution after the Student has successfully met all published Course and assessment requirements.
2. Acceptance of these Terms
By purchasing or accessing a Course you acknowledge that:
- you have read these Terms;
- you agree to comply with these Terms;
- you agree to all associated policies published by The Lash Edit and The Lash Institution, including the Refund Policy and Privacy Policy;
- you understand these Terms form a legally binding agreement between you and us.
If you do not agree with these Terms, you must not purchase or access the Course.
3. Eligibility
Students must:
- be at least 18 years of age; or provide written parent or legal guardian consent if under 18 years of age;
- provide accurate enrolment information;
- comply with all Course requirements.
We reserve the right to refuse or cancel enrolment where inaccurate information has been supplied or these requirements have not been satisfied.
4. Course Purchase
Upon successful payment:
- Course access will be provided through our nominated online learning platform.
- Access is granted solely to the purchasing Student.
- Course access is personal, non-transferable and non-exclusive.
- Purchasing a Course grants a licence to access the Course Materials only. Ownership of the Course Materials is not transferred.
5. Course Access
Unless otherwise stated:
- access commences shortly after payment has been successfully processed;
- access is intended for the individual purchaser only;
- Course access must not be transferred, shared, sold or assigned to another person.
Where lifetime access is advertised, this refers to the operational lifetime of the Course and Platform. We reserve the right to retire, replace or substantially update Courses where necessary.
6. Student Accounts
Students are responsible for:
- maintaining accurate account information;
- keeping login details secure;
- preventing unauthorised access to their account.
Students must not:
- share usernames or passwords;
- allow another person to complete the Course on their behalf;
- purchase a Course for multiple users using one account.
Where account sharing is identified, access may be suspended or terminated without refund.
7. Technology Requirements
Students are responsible for ensuring they have:
- reliable internet access;
- a compatible computer, tablet or mobile device;
- updated web browser software;
- the ability to stream online video content;
- access to a camera where assessments require photo or video submission.
We are not responsible for interruptions resulting from:
- internet outages;
- device failures;
- software incompatibility;
- forgotten passwords;
- third-party platform outages;
- user error.
Reasonable technical support will be provided where practical.
8. Intellectual Property
All intellectual property rights remain the exclusive property of The Lash Edit and The Lash Institution.
This includes:
- videos;
- manuals;
- PDF workbooks;
- presentations;
- lesson content;
- graphics;
- branding;
- logos;
- worksheets;
- downloadable resources;
- assessments;
- templates;
- photographs;
- educational systems;
- course structure;
- teaching methods.
Nothing within the Course transfers ownership of these intellectual property rights to the Student.
9. Copyright
Students are granted a limited licence to access Course Materials solely for their own personal education.
Students must not:
- reproduce Course Materials;
- record lessons;
- screen record videos;
- copy manuals;
- photograph restricted content for distribution;
- upload Course Materials online;
- share downloadable files;
- distribute worksheets;
- provide Course Materials to another person;
- reproduce any part of the Course for commercial purposes;
- teach or reproduce our educational content without written permission;
- create competing educational resources substantially based on our Course Materials;
- remove copyright notices or branding.
Unauthorised use of Course Materials may result in:
- immediate termination of Course access;
- cancellation of Certification;
- legal action where appropriate.
10. Student Responsibilities
Students agree to:
- complete the Course honestly;
- follow safe industry practices;
- use professional judgement;
- maintain appropriate hygiene standards;
- comply with applicable laws and regulations within their own location;
- obtain any licences, registrations or insurance required to operate their own business.
Students acknowledge they remain responsible for the services they provide to their own clients.
11. Assessments
Where a Course includes assessment, Students must:
- complete all required assessment tasks;
- submit work within published requirements;
- ensure all submitted work is their own;
- provide genuine evidence of practical competency.
Assessment submissions must not:
- be copied from another student;
- contain plagiarised material;
- be falsified;
- misrepresent the Student’s own skills or abilities.
Where dishonest conduct is identified, assessments may be rejected.
12. Certification
Purchasing a Course does not guarantee Certification.
Certificates are issued only where:
- all required Course content has been completed;
- all required assessments have been successfully completed;
- competency has been demonstrated to the standard required by The Lash Edit and The Lash Institution;
- all Course requirements have been satisfied.
Where applicable, students who successfully complete all required assessments and demonstrate competency to the required standard may be issued with a Certificate of Completion by The Lash Edit and/or The Lash Institution.
A Certificate of Completion acknowledges successful completion of the Course only.
Unless expressly stated otherwise, our Courses are not nationally recognised training, are not accredited under the Australian Qualifications Framework (AQF), and do not result in a government-issued qualification, diploma or degree.
Students are responsible for ensuring they meet any licensing, registration, insurance or regulatory requirements that may apply in their own state, territory or country before providing services to clients.
13. Right to Withhold Certification
We reserve the right to withhold Certification where a Student:
- fails to demonstrate competency;
- fails to meet assessment requirements;
- submits dishonest assessment work;
- breaches these Terms;
- breaches Course policies;
- engages in academic misconduct.
Where appropriate, reassessment opportunities may be offered in accordance with our Assessment Policy.
14. Course Updates
To ensure our Courses remain current and relevant, we may:
- update lessons;
- replace videos;
- improve learning resources;
- remove outdated information;
- add bonus content.
Course updates do not entitle Students to a refund.
15. Refunds
Refunds are governed by our separate Refund Policy.
Students acknowledge that Courses are digital products and access may be granted immediately following purchase.
Nothing within these Terms excludes or limits any rights available under the Australian Consumer Law.
16. Student Conduct
Students must conduct themselves respectfully when communicating with our educators, staff or community members.
We reserve the right to remove access where a Student engages in:
- abusive behaviour;
- harassment;
- discrimination;
- threatening behaviour;
- bullying;
- fraudulent conduct;
- repeated inappropriate communication.
17. Suspension or Termination
We may suspend or permanently terminate Course access where a Student:
- breaches these Terms;
- infringes copyright;
- shares Course Materials;
- shares login credentials;
- attempts to reproduce the Course;
- commits fraud;
- behaves dishonestly during assessment.
Termination for these reasons will generally not result in a refund.
18. Disclaimer
Our Courses are provided for educational purposes only.
Completion of a Course does not guarantee:
- employment;
- business success;
- financial outcomes;
- client acquisition;
- client retention;
- profitability;
- licensing approval;
- insurance approval.
Individual success depends on many factors outside our control.
19. Limitation of Liability
To the maximum extent permitted by law, The Lash Edit and The Lash Institution are not liable for any indirect, incidental, consequential or economic loss arising from:
- participation in a Course;
- reliance upon Course Materials;
- interruption of Course access;
- business decisions made by Students;
- use of techniques taught within the Course.
Nothing in these Terms excludes rights that cannot lawfully be excluded under Australian law.
20. Privacy
We collect, store and manage personal information in accordance with our Privacy Policy.
By enrolling, Students consent to the collection and use of personal information reasonably required to administer the Course, communicate with Students, assess submitted work and issue Certification where applicable.
21. Changes to these Terms
We reserve the right to amend these Terms from time to time.
The most current version will always be published on our website or learning platform.
Continued access to a Course after amendments take effect constitutes acceptance of the updated Terms.
22. Governing Law
These Terms are governed by the laws of Queensland, Australia.
Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
